The year started off with a bang. We won a historic, first-of-its-kind class action settlement against NorthShore University HealthSystem, a private employer that unlawfully denied approximately 500 health care employees their religious exemption requests to COVID-19 shots. As a result, NorthShore paid more than $10.3 million to compensate these health care employees who were fired. Many have been rehired at their previous seniority level.
Now that the final approval is granted by the court, the settlement checks will be sent out within 60 days. It is estimated that employees who were terminated or resigned because of their religious refusal of a COVID shot will receive approximately $24,000 each, and employees who were forced to accept a COVID shot against their religious beliefs to keep their jobs will receive approximately $3,700 each.
That’s not nearly what they should be getting. If they even get it. How does that pay for lost wages and loss of job? Plus attorney fees? Plus they should receive punitive damages.
