A Christmas gift for use in Covid-19 shot cases. Complaint and Exhibits filed on December 15, 2023, in Nelson et.al. v Hawaiian Airlines, a vax Title VII / ADA case (Lots of Plaintiffs). In particular, see Exhibit 2, the text of which is pasted below. Exhibit 2 is a FOIA response from the CDC. The CDC granted religious and medical accommodations to its employees; it apparently did not terminate any employees for not taking the vax; and it ended its vax program on January 24, 2022. Did the CDC mandate COVID-19 vaccines on its employees?
The CDC was in compliance with Executive Order 14043 which required all federal employees to receive their COVID-19 primary series. CDC Policy, in accordance with guidance from the Department of Health and Human Services and the Safer Federal Workforce Task Force, required that all federal employees must have received their primary series by November 22, 2021, except in limited circumstances where an employee is legally entitled to a reasonable accommodation, and complete vaccine verification by no later than November 8, 2021.

As of 10/29/2022, 469 CDC employees were unvaccinated for COVID-19. As of January 24, 2022, CDC no longer requires this information to be submitted by CDC employees

No, as of January 24, 2022, CDC does not require COVID-19 vaccines for newly hired employees.

Infuriating! Clearly follows the 1 rule for me, 1 rule for thee. I think back to January 2022, mandates going strong, and what so many of us were dealing with - testing of the unvaxed, people losing jobs, etc. Perhaps this is why, if I'm remembering the timing correctly that Wolensky was skirming around the questions re the CDC.
