I would like to know how a "EO" becomes law, or how a "federal mandate" becomes law. That is what the court is arguing. They refer to federal law throughout. Second, where is the argument about EUAs? That seems to be missing. 21 USC 360bbb-3, 45 CFR 46. The protection of human subjects? Where is that argument? NO company or agency can coerce, positively, or negatively, anyone to take, or inject, an EUA. When has a private company developed a litmus test, or universal standard, that would apply across the country for religious truism? When did this happen? Does Smuckers now have the capability to determine who is and is not a "true believer"? So, A) there was no Federal Law, B) an EUA can not under any circumstances be forced, and C) A private corporation can set its own standard for who is religious and who is not the right kind of religious and D) Rights of conscience no longer exist?
